WARRANTY LIMITATIONS THAT MAY AFFECT CONSUMER LAW
To the extent permitted by law, this warranty and the remedies set forth are exclusive and in lieu of all other warranties, remedies and conditions, whether oral, written, statutory, express or implied. Qwikfab disclaims all statutory and implied warranties, including without limitation, warranties of merchantability and fitness for a particular purpose and warranties against hidden or latent defects, to the extent permitted by law. In so far as such warranties cannot be disclaimed, QwikFab limits the duration and remedies of such warranties to the duration of this express warranty and, at QwikFab’s option, the repair or replacement services described below. Some states (countries and provinces) do not allow limitations on how long an implied warranty (or condition) may last, so the limitation described above may not apply to you.
WHAT IS COVERED BY THIS WARRANTY?
QwikFab warrants the QwikFab branded hardware product and accessories contained in the original packaging ("QwikFab Product") against defects in materials and workmanship when used normally in accordance with QwikFab's published guidelines for a period of six (6) months from the date of original retail purchase by the end-user purchaser ("Warranty Period"). QwikFab’s published guidelines include but are not limited to information contained in technical specifications, user manuals and service communications. QwikFab Products are warranted only to the end-user purchaser and is non-transferable.
WHAT IS NOT COVERED BY THIS WARRANTY?
This warranty does not apply to any non-QwikFab branded hardware products or any software, even if packaged or sold with QwikFab hardware. Manufacturers, suppliers, or publishers, other than QwikFab, may provide their own warranties to you but QwikFab, in so far as permitted by law, provides their products "AS IS". Software distributed by Qwikfab with or without the QwikFab brand (including, but not limited to system software) is not covered by this warranty. Please refer to the licensing agreement accompanying the software for details of your rights with respect to its use. QwikFab does not warrant that the operation of the QwikFab Product will be uninterrupted or error-free. QwikFab is not responsible and will not be liable for damages arising from use of QwikFab Products or from failure to follow instructions relating to the QwikFab Product’s use or from the breach of any warranty on QwikFab Products.
This warranty does not apply: (a) to consumable parts and materials, such as but not limited to extruders, hot ends, nozzles, 3D printing filaments, unless failure has occurred due to a defect in materials or workmanship; (b) to cosmetic damage, including but not limited to scratches, dents and broken plastic on ports; (c) to damage caused by use with another product; (d) to damage caused by accident, abuse, misuse, liquid contact, fire, earthquake or other external cause; (e) to damage caused by operating the QwikFab Product outside QwikFab’s published guidelines; (f) to damage caused by service (including upgrades and expansions) performed by anyone who is not a representative of QwikFab or a QwikFab Authorized Service Provider (“QASP”); (g) to a QwikFab Product that has been modified to alter functionality or capability without the written permission of QwikFab; (h) to defects caused by normal wear and tear or otherwise due to the normal aging of the QwikFab Product, or (i) if any serial number or warranty label and seal has been removed or defaced from the QwikFab Product.
Before receiving warranty service, QwikFab or aQASP may require that you furnish proof of purchase details, respond to questions designed to assist with diagnosing potential issues and follow QwikFab's procedures for obtaining warranty service. Before submitting your QwikFab Product for warranty service you may wish to maintain a separate backup copy of the contents of it’s storage media, if any storage media is present.
Following warranty service your QwikFab Product or a replacement product will be returned to you as your QwikFab Product was configured when originally purchased, subject to applicable updates. Recovery, reconfiguration and reinstallation of other software programs inclusive of system software, data and information are not covered under this warranty.
WHAT WILL QWIKFAB DO IF I REQUIRE WARRANTY SERVICE?
If during the Warranty Period you submit a valid claim to QwikFab or a QASP, QwikFab will, at its option, (i) repair the QwikFab Product using new or previously used parts that are equivalent to new in performance and reliability, (ii) replace the QwikFab Product with a product that is at least functionally equivalent to the QwikFab Product and is formed from new and/or previously used parts that are equivalent to new in performance and reliability, or (iii) exchange the QwikFab Product for a refund of your purchase price.
QwikFab may request that you replace certain user-installable parts or products. A replacement part or product, including a user-installable part that has been installed in accordance with instructions provided by QwikFab, assumes the remaining warranty of the QwikFab Product or thirty (30) days from the date of replacement or repair, whichever provides longer coverage for you. When a product or part is replaced or a refund provided, any replacement item becomes your property and the replaced or refunded item becomes QwikFab's property.
HOW TO OBTAIN WARRANTY SERVICE?
QwikFab may provide warranty service in two stages, warranty support service and warranty technical service. Please access and review the online help resources available at http://web.qwikfab.com before seeking warranty service. If the QwikFab Product at your discretion is still not functioning properly after making use of these resources, please contact an QwikFab representative or, if applicable, a QASP, by creating a support ticket at http://web.qwikfab.com or emailing firstname.lastname@example.org
WARRANTY SUPPORT SERVICE
By creating a support ticket at http://web.qwikfab.com or emailing email@example.com, QwikFab will provide warranty support service and QwikFab representative or QASP will help determine whether your QwikFab Product requires warranty technical service and, if it does, will inform you how QwikFab will provide it.
A support ticket is to address a support incident. A Support Incident is a specific, discrete problem whose origin can be isolated to a single cause. QwikFab will make reasonable efforts to resolve a Support Incident but does not guarantee that Support Incidents will be resolved. QwikFab, in its sole discretion, will determine what constitutes a Support Incident and to the extent permitted by law if the Support Incident is resolved. Generally, a Support Incident is resolved when you receive one of the following: (a) information that resolves the problem; (b) information on how to obtain a software solution that will resolve the problem; or (c) notice that the problem has been identified as a hardware equipment issue and advise with warranty technical service options.
Although Qwikfab cannot guarantee that a support incident will be resolved, QwikFab will make reasonable efforts to perform warranty support services in a professional manner. To the extent permitted by law, the express warranty and remedies set forth herein are exclusive and in lieu of all other warranties, remedies and conditions, whether oral or written, statutory, express or implied. As permitted by applicable law, QwikFab and its licensors specifically disclaims any and all statutory or implied warranties, related to or arising in any way out of these terms and conditions, including any implied warranty or merchantability or fitness for a particular purpose.
WARRANTY TECHNICAL SERVICE OPTIONS
QwikFab will provide warranty technical service through one or more of the following options:
(i) Carry-in service. You may return your QwikFab Product to a QwikFab or QASP location offering carry-in service. Service will be performed at the location, or QwikFab or a QASP may send your QwikFab Product to a separate location for service. Once you are notified that service is complete, you will promptly retrieve the QwikFab Product from the QwikFab Retail or QASP location, or the QwikFab Product may be sent directly to your location and shipping charges will apply and are borne by you.
(ii) Mail-in service. If QwikFab determines that your QwikFab Product is eligible for mail-in service, you may ship your QwikFab Product to a QwikFab or QASP location in accordance with QwikFab’s instructions. Once service is complete, the QwikFab or QASP location will return the QwikFab Product to you. All shipping charges for shipping to and from your location will apply and are borne by you.
(iii) On-site Technical Service. You may request for an on-site technical service of your QwikFab Product. Charges will be borne by you and are inclusive but not limited to man-hours, travel and/or transportation expenses and accommodation (if applicable). Charges may also include replacement product or part during provision of on-site technical service.
On-site technical service is only eligible at select locations. Please contact QwikFab for eligibility and estimate of charges.
(iv) Do-it-yourself (DIY) parts service. DIY parts service allows you to service your own QwikFab Product. If DIY parts service is available in the circumstances, the following process will apply.
(a) Service where QwikFab requires return of the replaced product or part. QwikFab will require (1) proof of purchase details, (2) shipping and handling charges paid by you to cover shipping of a replacement product or part and, (3) the return of the replaced product or part to QwikFab at your expense. QwikFab will not ship out a replacement product or part until all instructions are followed.
(b) Express service where QwikFab requires return of the replaced product or part. If you wish to receive the replacement product or part earlier, QwikFab will require (1) proof of purchase details, (2) shipping and handling charges paid by you to cover shipping of a replacement product or part and, (3) credit card authorization of an amount equivalent to the retail price of the replacement product or part and (4) the return of the replaced product or part to QwikFab at your expense.
If you follow the instructions, QwikFab will cancel the credit card authorization when QwikFab receives the replaced product or part.
If QwikFab does not receive the replaced product or part within 30 days, or QwikFab receives a replaced product or part that is ineligible for warranty service, QwikFab will charge your credit card for the authorized amount.
(c) Service where QwikFab does not require return of the replaced product or part. QwikFab will ship you a replacement product or part. Shipping and handling charges will be paid by you to cover shipping of a replacement product or part and QwikFab will not ship the replacement product or part until QwikFab is in receipt of the shipping charges.
(d) QwikFab is not responsible for any labor costs or damages you incur relating to DIY parts service. Should you require further assistance, create a support ticket at http://web.qwikfab.com.
QwikFab reserves the right to change the method by which QwikFab may provide warranty service to you, and your QwikFab Product's eligibility to receive a particular method of service. Service will be limited to the options available in the country where service is requested. Service options, parts availability and response times may vary according to country. You will be responsible for any and all shipping and handling charges associated with the services above. If you seek service in a country that is not in Singapore, you will comply with all applicable import and export laws and regulations and be responsible for all custom duties, V.A.T. and other associated taxes and charges. For international service, QwikFab may repair or replace products and parts with comparable products and parts that comply with local standards.
LIMITATION OF LIABILITY
EXCEPT AS PROVIDED IN THIS WARRANTY AND TO THE MAXIMUM EXTENT PERMITTED BY LAW, QWIKFAB IS NOT RESPONSIBLE FOR DIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES RESULTING FROM ANY BREACH OF WARRANTY OR CONDITION, OR UNDER ANY OTHER LEGAL THEORY, INCLUDING BUT NOT LIMITED TO LOSS OF USE; LOSS OF REVENUE; LOSS OF ACTUAL OR ANTICIPATED PROFITS (INCLUDING LOSS OF PROFITS ON CONTRACTS); LOSS OF THE USE OF MONEY; LOSS OF ANTICIPATED SAVINGS; LOSS OF BUSINESS; LOSS OF OPPORTUNITY; LOSS OF GOODWILL; LOSS OF REPUTATION; LOSS OF, DAMAGE TO, COMPROMISE OR CORRUPTION OF DATA; OR ANY INDIRECT OR CONSEQUENTIAL LOSS OR DAMAGE HOWSOEVER CAUSED INCLUDING THE REPLACEMENT OF EQUIPMENT AND PROPERTY, ANY COSTS OF RECOVERING, PROGRAMMING, OR REPRODUCING ANY PROGRAM OR DATA STORED IN OR USED WITH THE QWIKFAB PRODUCT OR ANY FAILURE TO MAINTAIN THE CONFIDENTIALITY OF INFORMATION STORED IN THE QWIKFAB PRODUCT.
QWIKFAB DISCLAIMS ANY REPRESENTATION THAT IT WILL BE ABLE TO REPAIR ANY QWIKFAB PRODUCT UNDER THIS WARRANTY OR REPLACE THE QWIKFAB PRODUCT WITHOUT RISK TO OR LOSS OF INFORMATION STORED ON THE QWIKFAB PRODUCT.
No QwikFab reseller, agent, or employee is authorized to make any modification, extension, or addition to this warranty. If any term is held to be illegal or unenforceable, the legality or enforceability of the remaining terms shall not be affected or impaired. This warranty is governed by and construed under the laws of Singapore. If the QwikFab Product is purchased online, the warranty is governed by and construed under the laws of Singapore.
